Π εριγραφή για το τι περιλαμβάνει η περίφημη ελευθερία του λόγου και ποια είναι τα όριά της, σύμφωνα με το Σύνταγμα και τους νόμους. «Καθένας μπορεί να εκφράζει και να διαδίδει προφορικά, γραπτά και δια του τύπου τους στοχασμούς του τηρώντας τους νόμους του Κράτους.» Το άρθρο 14§1 του Συντάγματος, που κατοχυρώνει την ελευθερία της έκφρασης σε εσωτερικό συνταγματικό επίπεδο.

Πρόκειται για το άρθρο 10 της Ευρωπαϊκής Σύμβασης των Δικαιωμάτων του Ανθρώπου (ΕΣΔΑ, ν.δ. 53/1974), που κατοχυρώνει την ελευθερία της έκφρασης σε ευρωπαϊκό επίπεδο. Οι τυχόν παραβιάσεις αυτού του άρθρου από ευρωπαϊκά κράτη δικάζονται από το Ευρωπαϊκό Δικαστήριο των Δικαιωμάτων του Ανθρώπου.

Πρόκειται για το άρθρο 19 του Διεθνούς Συμφώνου για τα Ατομικά και Πολιτικά Δικαιώματα, το οποίο κατοχυρώνει την ελευθερία της έκφρασης σε διεθνές επίπεδο. Το Σύμφωνο έχει δεσμεύει διεθνώς και την Ελλάδα (Ν.2462/1997).
